BEATALLICA Slapped With 'Cease And Desist' Order By BEATLES' Music Publisher - Feb. 17, 2005

BEATALLICA, the Internet sensation who combine the work of THE BEATLES with the sound of early METALLICA, have been slapped with a "cease-and-desist" order by THE BEATLES' music publisher over their "unlawful use" of the group's compositions "without authorization or license."

In the "notice of willful copyright infringement," which can be downloaded as a PDF file from this location (72 KB), Sony/ATV Music Publishing ? a copyright owner and music publisher of "compositions written, individually and jointly, by John Lennon, Paul McCartney, George Harrison and Richard Starkey" ? claims that BEATALLICA's use of THE BEATLES' compositions "without the express authorization or license has caused and continues to cause substantial and irreparable injury amd is in direct violation of Sony/ATV's rights."

When METALLICA frontman James Hetfield was asked last year by Kerrang! magazine if he's ever heard BEATALLICA, he replied, "Yeah. I heard that. That was amazing. Someone put a lot of thought and talent into that man!" Asked if he was being sarcastic, he said, "No, not at all. I heard it online. It was about a year ago, or more. It was pretty amazing. It was pretty well thought out so I'm glad there's people like that in the world to do that and it's very entertaining for us, for sure!"

LARS ULRICH Offers Support To BEATALLICA In Publishing Dispute - Feb. 19, 2005

BEATALLICA, the Internet sensation who combine the work of THE BEATLES with the sound of early METALLICA, have issued the following update regarding the recent "cease and desist" order that was sent to their Internet Service Provider courtesy of Sony/ATV Music Publishing.

"If you are seeing this news update, you are now aware of the cease and desist letter sent to our ISP [Internet Service Provider] by Sony. And that is just it. The cease and desist was sent to our ISP and not BEATALLICA or BEATALLICA, L.L.C. All we can say right now, is that we are looking into the matter and we will keep you all posted. Is there a chance our ISP could pull the site? Sure there is. Does Sony want the News, Music, Lyrics, and Merch sections removed? Yes, they do. This does not affect BEATALLICA's ability to perform live shows. More on that in just a bit.

"Let it be known that BEATALLICA, at this moment, is NOT getting sued by anyone in METALLICA or by any living Beatle. [BEATALLICA frontman] Jaymz actually had a conversation with Lars Ulrich since the cease and desist was sent and we're happy to say that the METALLICA camp is fully behind us and the integrity of BEATALLICA. Lars was very personable and we're thankful to have his personal time with all this. Over the last few dayz, there have been bangers from all over the world writing to us or writing on blogs/sites that have had concerns, comments, and rants about what is happening or what will happen. We do appreciate each and every one of you who is on our side, really. We know who our allies are and we look forward to extending relationships with the present folks who are Beatallibangers and Beatallibangers to come in the near future. We want to address the situation with the correct parties and come to a conclusion.

The Thursday, April 28th show at The Gasthaus at University of Wisconsin-Milwaukee is free, all-ages, and you can have beers if you're over 21?sweet! All BEATALLICA for 2 hours on that one. We do have a new show on Friday, April 29th at The Klinic Bar in Madison, WI with FLAT ATOM. Looking forward to getting back up there for sure. Lastly, in preparation for Milwaukee's Summerfest, we have Saturday, June 25th set for Vnuk's again with a TBA.
